Noel Jones Real Estate respects your right to privacy. As an organisation which discloses personal information to third parties for a benefit, service or advantage we are bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act). The APPs regulate how we collect, hold, use and disclose personal information, and how individuals may access and correct that information or make a privacy complaint.

This Privacy Policy explains how we comply with those obligations and has been prepared in accordance with APP 1.

The APPs regulate most of our activities with respect to personal information collected, stored, used and disclosed by us. However, the activities of all organisations directly relating to personal information of current or former employees contained in employee records are not covered by the APPs to the extent permitted by the Privacy Act.

Personal information we collect and hold

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

In our agency business, we may collect and hold personal information including (but not limited to) names, contact details, identification information, financial information, tenancy history, property transaction details, and other information required to provide real estate services or other obligations under any agreement with you.

We generally collect personal information directly from you, including when you:

  • engage us as an agent;
  • submit an enquiry, application or form (including tenancy applications);
  • attend an open for inspection;
  • communicate with us by telephone, email or electronic messaging; or
  • interact with our website, online platforms or third-party listing services.

In some circumstances, we may also collect personal information from third parties, such as landlords, vendors, referees, tenancy databases, or publicly available sources, where this is lawful and reasonable to do so.

ย Use of personal information

In our agency business, we use personal information collected from you for the purpose for which it was collected, that is to act as your agent and to perform our obligations under our agreement with you. This includes providing sales, leasing, property management, and related real estate services, and complying with our legal and regulatory obligations.

We may also include your information in our database to receive regular market updates and special offers. You may opt out of receiving these communications at any time by contacting us or using the unsubscribe function where available.

In providing the information you agree to this use unless you advise us differently.

Disclosure of personal information

We may disclose this information to other parties, including our service providers and professional advisors, as required to perform our duties under our agreement, to achieve the other purposes specified above or as otherwise allowed under the Privacy Act.

Depending on the circumstances, this may include disclosure to:

  • landlords, vendors, purchasers and tenants;
  • referees and tenancy reference database operators;
  • contractors and third-party service providers (including IT, data storage, marketing and communications providers);
  • professional advisers such as lawyers, accountants and auditors; and
  • government agencies, regulators or law enforcement bodies where required or authorised by law.

Some of our third-party service providers (including IT, data storage or technical support providers) may be located overseas or may store or access personal information from overseas locations. Some of our offices engage virtual assistants who are located overseas or who may access personal information from overseas locations. Where personal information is disclosed to or handled by overseas recipients, we take reasonable steps to ensure that the recipient handles the information in accordance with the APPs or as otherwise permitted by the Privacy Act, and that any virtual assistants engaged by our offices comply fully with the APPs and the Privacy Act.

Real estate and tax law require some of this information to be collected. If the information is not provided, we may not be able to act on your behalf effectively or at all.

Tenancy applications and property management

Personal information collected by us in the course of a tenancy application and any subsequent tenancy is necessary for us to verify your identity, to process and evaluate your application and to manage the tenancy. Personal information about you collected in the application and during the course of the tenancy, including through property inspection reports, may be disclosed to other parties as permitted by the Privacy Act including the landlord, referees, other agents and operators of tenancy reference databases. Information already held on tenancy reference databases may also be disclosed to us. If you fail to comply with your obligations under the tenancy agreement, that fact may also be disclosed to the landlord, other agents and operators of tenancy reference databases.

If this information is not provided, we may not be able to process your application and manage the tenancy.

Open house inspections and marketing

We use personal information collected from you during open inspections for security purposes. We may also use that information to contact you with respect to this property and others which we believe may interest you and for direct marketing purposes where permitted by law, including electronic communications. In providing the information you agree to this use unless you advise us differently. You may opt out of receiving marketing communications at any time.

If the information is not provided, we may not be able to provide an effective service to you. Other than in the circumstances allowed under the Privacy Act, we do not disclose information of this kind to other parties.

Storage and security of personal information

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Personal information is stored in both electronic and hard copy form, and we maintain physical, administrative and technical safeguards appropriate to the nature of the information held. Access is restricted to authorised personnel and service providers.

When personal information is no longer required for the purpose for which it was collected, and we are not required by law to retain it, we take reasonable steps to destroy or de-identify that information.

Access and correction

You may request access to the personal information we hold about you, and request that it be corrected, by contacting us using the details below. We will respond to access and corrections request within a reasonable period and in accordance with the APPs and applicable law.

Privacy complaints

If you believe that we have breached the APPs or mishandled your personal information, you may make a written complaint to us using the contact details below. Please include sufficient details to enable us to investigate the complaint.

We will acknowledge receipt of your complaint and aim to respond within a reasonable period, and in any event within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner.
